Digital Millennium Copyright Act (“DMCA”) Policy:

Pursuant to 17 U.S.C. § 512(c)(3), DMCA notices must:

  • Identify the copyrighted work(s) claimed to have been infringed;
  • Identify the material claimed to be infringing or the subject of infringing activity and that is to be removed or access to which is to be disabled (reasonably sufficient to permit service provider to locate the material);
  • Contain contact information (address, telephone number, email) for the complaining party;
  • Include a statement that the complaining party has a good faith belief that use of material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • Include a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and
  • Include a physical or electronic signature of a person authorized to act on behalf of owner of an exclusive right that is allegedly infringed.

Please note that failure to substantially comply with all of the above requirements may result in insufficient notice under the DMCA.

Upon receipt of a take down notice sent to Our designated DMCA agent, We will notify the corresponding customer using the IP range regarding your notice. In limited instances, where We offer hosting and/or ISP services to the corresponding customer, We have the ability to block that customer’s access to specific IP addresses. However, where the customer utilizes the IPs and does not utilize Our hosting and/or ISP services, We do not have the ability to control the customer’s use of the IPs, nor its use of specific content. In such instance, Our practice is to notify the corresponding customer regarding the DMCA notice and to forward the notice to their attention.
